These Terms of Use apply to cumberlandworklink.com and any page, form or document on it (the “website”). Cumberland Worklink is a business name of Xenolith Holdings & Acquisitions LLC, located in Monticello, Kentucky (“Cumberland Worklink,” “we,” “us” or “our”). By using the website, you agree to these terms and to our Privacy Notice. If you do not agree, please do not use the website.

1. Our prelaunch status

Cumberland Worklink is preparing to launch staffing services in Monticello, Kentucky and surrounding communities. The website describes services we plan to offer. It is not an offer of employment, a job posting or a promise that any service, position, worker, schedule, pay rate or start date is or will be available. Service availability, terms and pricing will be confirmed in writing before any engagement.

2. The candidate interest list

Joining our candidate interest list lets us contact you through the methods you choose when applications open or relevant opportunities become available. When you join:

• You confirm that you are at least 18 years old and that the information you provide is your own and is accurate.
• You understand that joining is not a job application, does not create an employment relationship and does not guarantee work, placement, hours, pay or a start date.
• You agree not to submit Social Security numbers, identity documents, financial account information or medical details through the website.
• You may update your details or leave the list at any time by calling 606-753-2120.

Any future application, screening, hiring or assignment will be a separate process with its own notices and agreements. Employment decisions will be made in accordance with applicable equal employment opportunity laws, without regard to race, color, religion, sex, national origin, age, disability, genetic information, veteran status or any other characteristic protected by law.

3. Information for businesses

Descriptions of temporary staffing, temp-to-hire and direct placement services are general information about services we are preparing to offer. They are not a quote, proposal or contract. Pricing, responsibilities, the identity of the employer, payroll, worksite supervision, safety obligations, screening requirements and any placement or conversion terms will be set out in a separate written agreement signed by both parties before work begins. If a written agreement conflicts with these terms, the written agreement controls.

4. Calls, emails and text messages

We contact people on the interest list only through the methods they select. Text messages are optional and governed by the text message terms in our Privacy Notice. Reply STOP to stop texts or HELP for help, use the unsubscribe instructions in any email, or call 606-753-2120 to stop any type of contact. Message and data rates may apply.

5. Acceptable use

You agree to use the website lawfully and not to:

• submit false information, another person’s information without their permission, or automated or bulk signups;
• attempt to access staff pages, private files or another person’s information without authorization;
• probe, scan, overload or interfere with the website’s security or operation, or introduce malicious code;
• copy, scrape or harvest content or contact information from the website by automated means, except for search engines indexing public pages; or
• use the website to send spam or to harass, threaten or mislead anyone.

We may block access, remove submissions or refuse service where we reasonably believe these terms have been broken.

6. Website content and ownership

The Cumberland Worklink name, logo, text, design and documents on this website belong to us or our licensors and are protected by law. You may view and print pages and our welcome letter for your personal, non-commercial use. You may not reuse our name, logo or content in a way that suggests a connection with or endorsement by us without our written permission. Links to other websites are provided for convenience; we are not responsible for their content or practices.

7. Disclaimers and limits of liability

We work to keep the website accurate and available, but it is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties, express or implied, about the website, including warranties of merchantability, fitness for a particular purpose, accuracy or uninterrupted availability. Information on the website is general in nature and is not legal, tax or employment advice.

To the fullest extent permitted by law, Cumberland Worklink and Xenolith Holdings & Acquisitions LLC, and their owners, employees and agents, will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunities, arising from your use of or inability to use the website. Our total liability for any claim relating to the website will not exceed one hundred U.S. dollars ($100). Some laws do not allow certain limits on liability, so some of these limits may not apply to you. Nothing in these terms limits liability that cannot be limited under applicable law.

You agree to be responsible for, and to reimburse us for reasonable losses caused by, your violation of these terms or your misuse of the website.

8. Governing law

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-law rules. Any dispute relating to the website will be brought in the state or federal courts serving Wayne County, Kentucky, and you consent to their jurisdiction, unless applicable law requires otherwise. If any part of these terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver of it.

9. Changes and contact
